These assets are protected by comprehensive United States and international copyright, trademark, and trade dress laws.
2. Protection of Collaborative Works
We take immense pride in our creative partnerships. All intellectual property resulting from collaborations between ToBeNamed Studio and our partner artists, designers, or brands is strictly protected.
- Joint Ownership: Rights to collaborative designs and co-branded content remain vested in ToBeNamed Studio and/or its respective partners.
- Third-Party Protection: Unauthorized use of partner-related imagery, names, or likenesses featured on our platform is strictly prohibited and may constitute a violation of both our rights and the rights of our collaborators.
3. Proprietary Design & Trade Dress
Our product portfolio represents a unique aesthetic identity.
- Design Exclusivity: All jewelry, objects, and apparel designs—whether individual or collaborative—are proprietary. The unauthorized manufacturing, distribution, or "imitation" of designs that are substantially similar to our original works is a direct infringement of our intellectual property.
- Trade Dress: The "look and feel" of our packaging, website interface, and brand presentation is unique to our Brand ID. Any attempt to replicate this aesthetic to cause market confusion is strictly monitored and subject to legal action.
4. Trademark & Brand Identity (ID)
The name ToBeNamed Studio, our signature marks, and all stylized brand identifiers are legally protected trademarks. You may not use our brand identity in any manner that suggests an unauthorized endorsement, sponsorship, or affiliation. Any use of our Brand ID for commercial gain without a formal licensing agreement is strictly prohibited.
5. Professional Imagery & Asset Usage
Our visual assets are a core component of our intellectual property.
- Commercial Restriction: You are prohibited from downloading, scraping, or utilizing our product photography or editorial content for any commercial purpose, including use on unauthorized retail platforms or third-party marketplaces.
- Editorial Use: While we appreciate brand enthusiasm, any non-commercial use of our imagery on social media must include clear attribution to @ToBeNamedStudio and our respective partners where applicable.
6. Enforcement of Rights
ToBeNamed Studio actively monitors for the unauthorized use of our intellectual property. We reserve the right to pursue all available legal remedies to protect our designs, our brand identity, and the interests of our collaborative partners.
